Legal Question in Landlord & Tenant Law in Texas

Breaking a lease...

Hi, i was wondering if there is any way i can get out of a lease without having to pay for it. We live in a complex that has broken like 19 codes with the city, they have been on the News, the city has taken them to court-and they are not finished yet, the management company has filed bankruptcy, we didn't have hot water for 3 weeks, our apartment leaks (we are on the bottom) and we have bugs. No one EVER answers the phones and the office is ALWAYS closed, except for the day we have to pay rent so i have to wait until the 1st to give them a written statement that something is wrong, our roof could fall in by then. I was offered another place to live by a friend, but i didn't know what to do about the apartment. I'm only 23 and this is my first apartment and i don't want to ruin my credit because the complex can't fix their stuff. What can i do??

Re: Breaking a lease...

Based on what you have stated, there may be a possibility that you could break your lease for non-habitial conditions (e.g. change of conditions). Additionally, landlords are required to make repairs that materially affect the physical health or safety of the tenant (e.g. roaches, rates, sewage backupos, lack of hot water, faulty wiring, violations of the city health code or fire code). If my law firm can assist you with this legal matter or any other legal issue, please contact my legal assistant Jennifer ([email protected]).
