This is a vague question that requires more information.17 is a minor.

For an injury to a minor not involving death, the parents are entitled to bring a claim for compensation for the medical expenses incurred by the parents for the minor. The parents may also act as "next friend" in order to bring a claim for the injured minor's damages because a minor generally cannot bring a lawsuit on their own. Under such circumstances, the parents can bring the claim for pain, suffering, impairment, future medical and all damages that would be available to the minor. That money goes to the minor once the minor turns 18. The parent may also bring a bystander claim on their own behalf for any mental anguish suffered if the parent saw the minor get hit.

If the minor did not survive the wreck, the parent could potentially bring a wrongful death claim on behalf of the estate. This would be for all damages the child would have had if he survived plus other potential losses to the estate. The money recovered ultimately goes to all heirs of the estate.

That is as specific as i can be without all of the facts. Please feel free to call us if you would like more information specific to your case.

I am sorry to hear about your injury.

It is hard to answer your question as it is very broad...but generally recovery can be made for actual economic damages and for "non-economic" damages..which include pain, suffering, mental anguish, etc..

This is not a case that someone should try to handle without a lawyer...

I am a personal injury lawyer in Austin and regularly take cases in the San Antonio area.
