Legal Question in Personal Injury in Texas

how should i handle

My son was shot in the hand with a pellet gun at a friends house. The pellet was embedded in his finger, he had to have emergency surgery. I have insurance, but the ordeal was over 8k, and my 12 year old has a horrid scare .. this happened about 6 weeks ago.

Parents are generally liable for the "torts" (or negligent acts) of their children, and the parents' homeowners policy would be available to you for compensation. There are two basic components of the policy that would apply here: the "liability" portion and the "med-pay" portion. You need a personal injury attorney to succeed in obtaining all the benefits you and your child deserve. Please call me at your earliest opportunity.

The friend's house probably has homeowner's insurance which should compensate for the accident...but you will probably not succeed without a lawyer. Call us or a competent personal injury lawyer in your area..

First keep copies of all records.

If you have any photographs of your son's hand after the injury hang onto them.

If your soon saw a therapist or counselor after the injury, keep records of that as well.

The better documented the injury and expenses are, the more you are likely to recover.

How your son was shot affects whether or not the homeowner's insurance will cover his surgery. Accident's are more likely to be covered than intentional acts (was someone using your son for target practice)

You need to see a lawyer soon. Generally claims like this are barred after two years from the date of injury.

Good Luck!
