Legal Question in Personal Injury in Texas

Injured child

My exhusband was dropping off our 11yr old son with his 3yr son and 2yr old daughter with current wife. His 3yr old son asked to jump on my sons trampolene, I said it was up to them and so he took the boy and his 2 yr old daughter that I did not say could get on it and once he put them on it he walked back into my home where his wife and I were talking, his 2 yr old daughter fell in the middle of it onto my 11yr sons leg. She cried and they went home. The next day she was still hurting so they took her to the hospital and found out her leg is fractured. Since I did not say she could get on there and he put her on then walked away, Can I be held liable? Him placing her on the trampolene was without my knowledge or consent and under his supervision not mine. When he did come back inside both his wife and I told him not to leave them outside alone. That is when she started crying. I was angry that he left our 11yr old to handle a 3yr 2yr and my 5yr daughter all on the trampolene. My son can not catch 3 toddlers. But can he hold me liable because it was my property and trampolene???

Re: Injured child

turn it over to your Homeowner's insurance, let them make the decision...it may reeuire your ex and wife to get a lawyer..but you chould not be out anything..AND it does not affect your insurance premiums.

Some homeowner's insurance has accidental coverage..about $1000 to $10000..
