Legal Question in Personal Injury in Texas

nursing home lawsuit

mother injured in nursing home and sustained injuries due to neglegence. my brother has power of attorney. if i make a lawsuit and win the case who recieves the money. my mother is incapacitated and has dementia. if she passes away then who recieves the monetary damages.

While your mother is alive, any funds received would be hers. So, your brother would likely receive those funds to be held for the benefit of your mother. Upon her death, the $ would go to the persons named in her will or, if she were to die without a will, her heirs at law.
