Legal Question in Personal Injury in Texas

I was rear ended at a red light. The guy was operating a vehicle that was insured and registered to his son. The son gave the adjuster a false statment saying that he hit me but it wasn't his fault because someone else rear-ended him. Is it against the law to give a false statement on an insurance claiim?

The question is vague and difficult to answer.

Apparently you are stating that the man who hit you is lying to his insurance company about the facts of the accident and asking if it is "against the law."

If it is against the law it would be up to the mans insurance company to report it to authorities.

Also, how would one prove he is lying?

Assuming you can prove he is lying, then it would be best to prove this after he makes this statement under oath, possibly at a deposition.

If the man is lying to the police, and if it can be proven, and a police report is generated based on his false statement, then I believe it is against the law. I do not remember the specific statute, however.

I suppose you may be able to make a police report of this false statement or file a criminal complaint if you are the victim of a false statement made to the police.

Always attempt to obtain a second legal opinion, if possible.
