Legal Question in Real Estate Law in Texas

Hi -

I purchased a property in Texas ( I live in California) and was told via email by the agent that I would receive 1.5% cash back on purchase.

I explicitly emailed him to view information on 2 properties I may purchase, and then asked him if he gives cash back on purchases. He said they usually don't, and so I replied that I need an exact answer on whether or not he would. He said he would give 1.5%.

I said i was ok with that, which is why i began using him as my agent (if he didn't offer cash back, I wouldn't have used his services).

When I was closing on the property I emailed him for the process to get the cash back.

He then replied and said he wouldn't give me cash back since I didn't purchase 2 properties (he never said i had to purchase 2 properties) and because the process for closing took longer than normal.

Can I legally get my cash back, since I have proof of him saying that he would give it?

Please let me know.
