Job Loss over Sexual Harrassment Claim

My daughter filed a sexual harassment claim against a man (higher up) in her company about 3 or 4 months ago. She was very well liked and did her job well up to that point. Since filing the claim the company began to find reasons for being unhappy with her work, i.e. attitude, giving her wrong information so the work she did would turn out wrong. After approx. 3-4 months of this they have fired her. Does she have a case against them? The man who harrassed her still has his job and she's out the door.

Your daughter may well have a good case for retaliation against the company and she should certainly explore this with an experienced employment lawyer who concentrates in the area of sexual harrassment.

What type of harassment did he engage it? Was everything oral, any emails, notes, was there any inappropriate physical contact?

Was he her immiediate supervisor?

Was your daughter's complaint of sexual harassment documented in writing? Did she ever go to the Equal Employment Opportunity Commission or the Texas Workforce Commission? At first blush it sounds like she has a good case for retaliation as well as a case for the underlying harassment complaint. Do you know if your daughter's complaint against the harasser was the first time someone complained? Keep in mind that there are strict timelines to be met in order to bring claims for retaliation and harassment. 300 days from complaint to file with EEOC and 180 days from complaint to file with Texas Workforce. One of these entities has to be notified within those time frames or you will lose your right to bring a lawsuit. Feel free to call me at 214-521-2300 to discuss further.
