Death without a will

My mother passed away in July of 2001 without a will. My sister has taken her car out of my mother's name and put it in to hers in Sepember 2001. I have not signed anything or was not told she was doing that. What can I do to claim my part of my mother's things and her car.

Re: Death without a will

You didnt mention if your mother was married at time of death. Assuming not, then her assets will pass equally to all her children. You can file for an administration of your mother's estate with the probate court in the county she lived in at time of death. If your sister doesnt consent to you being an independent administrator, then you are looking at a dependant estate (ie. expensive)

How did your sister transfer title? IF your mom had allready signed over title, then not alot that can be done. I suggest that you contact your sister and try to work out an agreement else you are looking at a costly litigation for all.

Good luck.
