Legal Question in Wills and Trusts in Texas

My Mother is 73 yrs. old with stage 2 dementia. Neither my brother or I have power of attorney for Mom and are wondering how to go about obtaining it. We are soon to move her into an assisted living facility and one or both of us need to be able to make decisions on her behalf.

IMHO stage 2 is not so impaired they don't understand what their rights/duties are...so if a doctor gave her that diagnosis, have the doc confirm she is sui compos..ie mentally capable of appointing someone a POA...then ...most lawyers could prepare one......but it is a form approved by the State in Texas
