Legal Question in Family Law in United Arab Emirates

Attention: Atty. Hassan Elhais

"I'm an expat and would like to file divorce from my estranged husband in my home country. How do i get on with the process and how much does it cost, and how long would it take (considering that the other party is agreeable)?"

I'm Christian and so is my husband. I have 2 sons ages 16 and 13, and a daughter age 12.

Thanks

Hi,

With reference to your query, you have not mentioned your Country of origin, where you intend to file the Divorce case. If by chance, you are from India, you may note that as you are both Christians by religion, there is no provision, as per the applicable law to seek for Divorce based on mutual consent. The grounds of divorce are limited as per the law applicable to Christians. You may provide the necessary information as to the grounds for your seeking divorce, regarding the custody of your children, whether you are seeking for maintenance, whether your Husband is presently residing at your home town, where you are located, presently where are your children residing, etc, as only with the necessary information, it would be possible to advise you suitably.

For further clarification, you may mail to [email protected] or call on 050 2104389.

Best Regards,

Shaji.K.N
