private car sales
i advertised my car with a local company and i recieved no response other than another internet company contacting me wishing me to advertise my car with them which i finally did so. i was promised they could sell my car within 3 days for a fee of 42 pounds. After 3 days i contacted the company to ask if my car was being advertised, i was told the company had ICT problems with one of hteir branches which meant it was not advertised as of yet but thye would investigate the problem. I rung again the day after and i was told the same story and they would yet again investigate the problem and they would contact me back, but no one did. By the 6th day of non advertisement i told them i was very disafisifed with their service and would pull out my advert if they could not advertise it and solve the problem. Yet again i was told they would investigate the problem and someone would ring back but no one did. So i rung first thing in the morning of the 7th day to withdraw by advert and to ask for a full refund because they have not advertised my car nor sold it within their time limit as promied. They told me that they did not promise to sell my car within 3 days nor would i get my money back. please help?

I am afraid that you have fallen victim to what is a fairly well-known con by unscrupulous companies. The legal position is quite straightforward but the remedy much more difficult. You clearly entered into a contract with these people and equally clearly they are in breach. The legal remedy for this is the return of your money and any damages which have resulted. Unfortunately for the amount involved, these companies work on the basis that you will not consider it worth the time and expense to take matters further and bring court proceedings. This is indeed often the case, but if you are prepared and feel strongly enough about the matter it is open to you to bring a claim under the small claims procedure at your local County Court.
