Change of Name and Passport Application

My children's father and I split up in 1993, we were never married although his name does appear on the birth certificate of both. In 1997 I changed the surnames of my children via Change of Name Deeds drawn up by a solicitor. At the time I had sole parental responsibility for my children. Their father applied for parental responsibility and contact some time later and orders were granted showing my children by their 'new' surnames. My eldest child is now almost 16 years old and was hoping to go to Tenerife for Christmas with my parents but the passport office won't give him a passport without his father's consent to his Change of Name. Can they refuse this even though the Change of Name deeds were in place before he had 'parental responsibility'?. I am desperate to sort this out - there are only 11 days left before he is due to travel and he will be heartbroken if he can't go.

If your son is to go to Teneriffe for Xmas, the time restraints are such that you are going to have to accept that the father's consent to the change of name is the only way this is going to easily happen.

Unfortunatly his agreement as is required when a person has PR to a change of name was not obtained. If he will not now agree-it will mean an application to the Court. This can be done but is pushing it before Xmas.

If he will really not agree and you want to discuss I will do what I can.
