Legal Question in Family Law in Utah

custodial parent rights

What age does the child have to decide whether or not they have to go and spend the weekend with the non custodial parent on that weekend? How long of a wait does the custodial parent have to wait for the non custodial parent to come and pick up the child before the custodial parent can legally leave with the child? What age does a child have to request the last name to be changed to the mothers maiden name if they are under the age of 18?

Re: custodial parent rights

Children do not make these descisions - they are made by the parents or the court. If your child is about 10 or older, a court will listen to the child's input in making its final order. A parent should wait a reasonable amount of time - 20 minutes is usually considered reasonable, but circumstances vary. The noncustodial parent should notify the custodial parent if later than that and make arrangements. A child can request a name change with the parent's permission under age 18, but the noncustodial parent still has input on the name until the child is 18.
