If there is no custody assigned, can either parent take the child?

It depends on whether the parents are married. If so, then either parent has the right to have custody of the child. If they are not married and paternity has not been formally established, then the father doesn't stand in the same position as the mother in having custody. Frankly, it's not good to have the child bouncing back and forth and used as a pawn between the parents in some tug-of-war.
