Termination without Cause

I was terminated from my position and given severance pay. I asked my supervisor at the time of my termination what the reason was and was given a vague answer about time for a change. Upon filing for unemployment I discovered my prior employer was listing the reason as misconduct. Do I have any recourse against this employer for misinformation?

Perhaps your employer was thinking he was being kind in telling you time for a change when in fact it was for some perceived misconduct. Or perhaps there was no misconduct and your employer doesn't want to pay unemployment.

Ask for a copy of your personnel file. They will withhold some documents but get as much as you can. Get in writing as much as you can.

It may be that in the end your only recourse is to sue to find out all the information relevant to your situation, and that may not be worth your time, trouble and expense. Good luck.

You can file a grievance with your employer. You can also file for unemployment insurance (if not waived) and if the employer objects, ask for a hearing. At the hearing the employer must explain the misconduct, and you will have a chance to rebut the information.
