Legal Question in Medical Malpractice in Utah

Our horse was suppose to have been gelded,but he is proud cut instead

Earlier this year we bought a horse and thought we was paying to have him gelded,but instead he is only proud cut.and now we have to get rid of him before he runs our mares to death or himself. Being gelded means he should no longer preform with mares.But recently we have had to put him in a corral by himself because he was running one of our mares into the fence trying to breed with her.The only thing we can do since the vet messed up now is to get rid of our horse.We know he can not produce anymore offsprings But he isn't suppose to even be able to produce the action. What can we do since we are basicly being forced to get rid of him in order to save our mares?Getting rid of him had never crossed our mind until all this happened.And it isn't right that it has to be this way.I do hope you can help us out on this.Thank-you in advance

Before you get rid of him, get back with the vet and see if there is anything that can be done first. You may want to get an opinion from 2 vets. If the first vet erred, and it cannot be corrected, you might have a cause of action against the vet for the difference in value between a gelded and proud cut horse.
