Legal Question in Real Estate Law in Utah

The area behind my condo unit is designated as "private area". A recent amendment to the CC&r's now refers to this area as "common area" without a change to the Plat map. Essentially this has taken away my private area. Is it legal to take away this area? Thank you

The answer to the question lies in the CC&Rs;and the language of the amendment. Assuming that the private area was your private area under the language of your title, that area cannot be taken away.
