Family Allowance

It has been 10 months since the deceased passed away intestate. We have asked for a family maintenance amount (to replace child support) until the Estate is settled. Still nothing. Is there some way we can file for some immediate support for the children from the Estate?

Yes, you can open probate (if not opened) and get a personal representative appointed, then file a claim for temporary support. You may call for a free consultation.

You will need to file a petition for the family allowance with the probate court, if the deceased was domiciled in Utah at the time of death.
