Legal Question in Wills and Trusts in Utah

Property left to sibling but not put in will.

Four years ago my Father died. All the siblings understood and agreed that a small property that was in my Fathers name was to go to me the oldest. Each of them did a general Affidavit that was notarized. I just went in today 8/28/08, to have the property changed into my name but was told it has to go to court. What should I do now?

Re: Property left to sibling but not put in will.

You are required to open and file probate on your father's estate. Title is still in the name of your father, and a court order is required to transfer title into your name. You may call for a free consultation.
