Can an ex-girlfriend steal from a joint bank account?

Hi this is sort of a thrid party question but it pertains to me also. My boyfriend and I were going to purchase my engagment ring and when I got home from work he told me not to be angry at him. He told me that he had been saving money behind my back for just this occastion and that he went to the bank and the money was gone. He said he about a $1,000 dollars and it is all gone. He also reminded me that his ex-girlfriend and he shared a joint bank account. They had long since departed from each other and she moved back to VA, well she must have one day stumbled upon the money and took it out of the bank account. Now here is my other question, what can we do? What rights do we have? Please answer my question we are at a lose here and we have no clue what we should do because we do not want this to get turned around on us.

PS we are getting all the bank statements because there is only two NorthMiddlesex Banks in the country. And she also has been in prison for a year for credit card fraud.

You might call it stealing, but your boyfriend put her in a position to take the money out of the account, the real question is, in what ownership the account indicates the money in it is held? She may be a co-owner of the account, and the money in it. The actual ownership may have to be litigated, but is it worth it?
