Legal Question in Construction Law in Virginia

basement flooding

our home is 5 yrs old. in the last 12 months our finished basement has flooded 3 times - wall to wall water 4-5 inches deep. we replaced our sump pump for larger, more powerful pump and replaced the exit pipe to minimize angles/resistance. still basement flooded again. now a drainage specialist has measured that a 36'' storm sewer drain pipe running alongside our house is only 10'' lower than our foundation and both sit on a gravel bed. the builder of our home also engineered the storm drain. could this be the reason for our floods and would this be considered a structural warranty item which they should be responsible for fixing?
