Legal Question in Construction Law in Virginia

mechanic's lien on an addition

We had a two room addition completed, based on a written contract. Additional items were completed during the job and the contractor attempted to bill us afterwards. Can he claim this on a mechanics lien? We are refusing to pay, since no written change order was completed.

Re: mechanic's lien on an addition

More facts are needed to reliably answer this inquiry, but if these additional items that were completed by the contractor without a written change order were reasoanbly connected with the completion of the two room addition, their costs may be enforceable under the original written agreement and validly subject to a mechanic's lien.
