Legal Question in Criminal Law in Virginia

Criminal law

I am 16 and while at a private

party was given a citation for

underage possession of alcohol with a

breathalyzer of 0.05. Will this affect

my ability to get a driver's license?

Will it be on my permanent record?

Should I get a lawyer? It is my first

offense of any sort. Poor judgement

on my part-never again. Thank you.

Yes, if you can afford a lawyer to represent you in this matter, it would be a good idea in order to ensure that the correct steps have been taken to minimize the consequences of your first encounter with the criminal justice system.

However, if you cannot afford to hire an attorney, see the prosecutor before court begins and tell him/her that you would like the deferred disposition (Va. Code Sec. 4.1-305(F)for your case that will allow you to emerge from this incident with no record of a convviction if you successfully complete the terms of your probation.
