Legal Question in Criminal Law in Virginia

where do i get help

my nephew was arrested in norfolk,va he is mentally ill, but the employee we talked to say that is not his status there and that we have to prove that he is mentally ill. we have tried to get his records from the communtiy service board where he was seen but they say it will be a month and he can't wait that long. he has not been assigned an attorney and because of his behavior he has not been before a judge to be assigned one. my parents whom he lives with are on social security and cannot afford a private attorney. where can we go to get him some help before he gets hurt. we were told when he first got ill that he is a parinoid schizophrenic who gets violent when he is confronted or when he feel like he is being threatened.

Your nephew is entitled to a court appointed attorney if he's being detained in police custody and cannot afford to hire a lawyer on his own, and, if such is the case, he should contact the clerk of the criminal court to request that one be appointed immediately to represent him

in whatever criminal matter with which he's been charged.
