Legal Question in Family Law in Virginia

Child Custody

I am writing for my son who has a 5 year old daughter (Haley) and the custody just got changed in favor of the mother. No one even looked at the documents that he had bought in, he has calendars showing how much time he had her (18-25 days a month), the mothers arrest record showing she was arrested for assault & battery and served jail time, a drs. record showing that Haley had 2nd & 3rd degree burns that the mother did not get her medical attention, she was in the mother's care when this happened.

Does he have enough to get this appealed? They had shared custody and the mother wants more money is why this is be taken back to court. The judge gave him weekend visits and Wednesdays for 3 hours and 2 wweeks in the summer. He pays child support for Haley and the mother had to start paying child spport for a son that she has with another man and the father has custody of him.

The mother also had Haley put on ADHD medication by a family doctor and he wants her tested and had an appointment and she canceled it, how can he demand that this is done. Two therapist have said that they do not believe she is ADHD.

She has moved 10 times and has had 4 live in boyfriends and the courts don't seem to care.

Please help me.

Re: Child Custody

You don't indicate whether your son was represented by a competent attorney, but if not(and it sounds like not), and he's unhappy with the outcome, he should appeal(most likely 10 days to do so) and this time spend the money that will be necessary to retain the services of counsel who can properly present his case to the court and make the appropriate arguments in support of his position(s) in the custody matter.
