Legal Question in Family Law in Virginia

My friend's ex girlfriend's husband thinks he can just adopt my friend's child to spite him. That can't happen unless my friend signs saying its okay. Am I correct?

Yes, unless your friend was found so unfit to be a mother by a court that it

terminated her parental rights. However, aside from that, courts do not award adoption decrees to petitioners who are merely seeking their new legal status as fathers or mothers out of spite for someone else, be it the biological parent of the subject child, guardian, or other person.
