Legal Question in Family Law in Virginia

Which state do I file from

My husband and I are getting divorced. He is in the Navy, stationed in VA. I have moved back to my parents home in SC to have my baby. Can I get an attorney from SC or do I have to return to VA?

Re: Which state do I file from

You would have to contact an attorney in SC to check on what they require for filing for divorce in that state. However, Virginia is an option because you last lived as husband and wife here and your husband still resides in the state. If there are any further questions that we may assist you with, please call our office at 703-777-7319. Thank you.

Once you achieve the status of being a legal resident of South Carolina, you may initiate divorce proceedings in that state.
