Legal Question in Civil Litigation in Virginia

Conflict of Interest

I obtained an atty for child custody and other abusive matters upon separation from my ex. Now I am remarried and my husband and I are considering divorce. He is trying to obtain an atty from the same firm for our child custody and abuse matters as well.Although it was a separate atty, they converse with each other on matters. I am certain that past issues will be brought up in this case. Is it not a conflict of interest for him to hire an atty from this firm?

Re: Conflict of Interest

Clear, unequivocal conflict of interest which the law firm will or should recognize. He can't have an attorney from any firm that has represented you. Period.
