Legal Question in Civil Litigation in Virginia

Friend Owes Me Money and Wont Pay

A friend and I agreed to purchase a motorcycle together, I was to front the money he was to obtain and sell it. Buying and Selling motorcycles is my friends current occupation and we have done this before. I deposited the money into his account and he purchased the bike from someon he knew in Myrtle Beach. The bike was stolen on the way back to VA from Myrtle Beach. My friend was going to file a claim with his insurance but did not have the title yet and the insurance company was suspiscous, they started a fraud investigation on him. I pulled the claim and told me he would get me the money. This was in July 2006, to date I have not seen a dime. What do I need to do to get my money back from him. He has equity in his house and several cars & motorcycles but claims to me he has no money and has bad credit. I am afraid this has bruised our frienship permanently and I want my money back. I want the $8500 back plus interest. I look forward to any response.

Re: Friend Owes Me Money and Wont Pay

You could sue him in small claims court for $5000(the limit) or general district court for the full

$8500. Once a judgment is awarded you, you could then seek the advice of an attorney as to how best to enforce it.
