Legal Question in Insurance Law in Virginia

AD&D insurance

While getting divorce from my X, I took out an AD&D on myself, spouse and children. In the policy it stated all parties must have the same primary residence. A few years later he killed himself. When I asked the ins. customer service rep. about coverage. They said only parties living together at point of death are insured. Is this an enforcable point? Insurance Co. is Affinion Group. Policy taken when I lived in VA. He moved to DC. I moved to NJ during the year of his death.

Re: AD&D insurance

It is impossible to answer this question without looking carefully at all of the documents, starting with the insurance policy.

I would not be surprised at all if the insurance company denied your claim even if you had a good basis for it. Living in the same residence? What? Possible but not sensible.

I see you are in south Jersey. I am in north Jersey, near New York City. I would be very happy to assist you, if you wish, but a lawyer near to you may be a better choice. You need someone who has (and ask this question) fought with insurance companies over 'coverage' issues. I have.

If you decide that you would like me to assist, please call my office. I am in Hackensack. You can then decide how you would like to proceed.
