Legal Question in Employment Law in Virginia

I am the employee of a retail big box store that has adopted a no smoking policy and now has ammended it to include the use of tobacco in your private vehicle on your unpaid/off the clock lunch hour. This is in Virginia.This can mean termination if you are in your car and on the parking lot ,on or off the clock. Can something like this be enforced? Wouldn't it have to include the public that parks there to shop in order for it not to be discriminating.
