Leasing agreements

I have a current lease with my roomate in which was sign by myself but my roomate did not sign. His name is on the lease, but He refused to sign. My lease is signed by my landlord and me. Can Can he stay if I ask him to move out?

If your roommate is not on the primary lease signed by your landlord and you, and he did not sign what apparently is a sublease between you and him (for which I assume that you had your landlord's permission), then there is no more than an oral lease or tenancy between you and him, which would likely allow him the right to stay on your rental premises no more than 30 days after you tell him to move out. (In other words you can terminate his oral lease upon giving him 30 days advance notice. Then he must move out.)
