Legal Question in Personal Injury in Virginia

Serious accident

We hade just come back from a newyearseve party when we had a green light we see a guy inching forward and then stops then we go and he floors his engine, he totaled our car so we had too get a new one. The policeman said he was so drunk he could not speak nor stand. The police wonder how he got in his car. We were rushed to the E.R.I am undergoing many, many injection because my knee was smashed in the accident i will be undergoing 2 more operations, the doctors think. I can not walk up the stairs with out strugling, i even have trouble walking through our house. My husband was asked if he swore this was the guy who hit us, but he could not because his was smashed up against the dashboard. It has been two years and we have tried and failed. We would like to sue him for the car, medical bills, plane trips and bus trips because i can not walk far, etc. We would appreciate it if you could help us. Thank You SO much.

You have 2 years from the date of the accident to file suit for your personal injuries and 5 years for the property damage. Even if your husband cannot identify the guy, and assuming the statute of limitations hasn't run and that you had a liability insurance policy in force at the time of the accident you still have a vehicle for recovery.
