Legal Question in Personal Injury in Virginia

collecting on a judgement.

I live in Va and I have a judgement against a man in Michigan. I need to know what is the best way to go about collecting on it. The judgement was awarded to me from a judge in the Commonwealth of Richmond,Va after the gentleman failed to appear at the court date. ( 2 of them)

Unless he has some property, money, or assets in VA, you would have to do this in Michigan. And I don't know anything about Michigan law. You should repost your question under Michigan law to see if a MI lawyer can help you.

One thing you may have to consider is that some states (like NY) will not recognize a default judgment and woudl require you to put on your entire case all over again in a MI courtroom. I don't know about MI. I am just saying it is a question you have to consider. I have run into that with other states.

So you should think long and hard about whether he has anything in VA, or anyone in VA owes him money. Hint: If his bank is both in MI and VA, you MIGHT be able to garnish his bank in a VA court, but sometimes they are actaully different corporations for different regions of the country.

Does he do any business so that a Virginia business pays him money?

If you want to get really creative, you might be able to try to seize his website domain name (if he has one) in Virginia because I believe Network Solutions is here. But now you are really in uncharted waters, and that would be tricky. I almost did that once, but did not need to.
