Legal Question in Real Estate Law in Virginia

Mortgage/credit question

We found several fraudulant issues with our loan application while trying to refinance. Currently we are working to get the loan remodified so that we do not fall into foreclosure. Can I sue the brokerage firm that lied on my application ? Also, the house is only in my name as well as the loans, however it seems that my husbands credit is being hit by this as well, is that legal if he never signed any of the paperwork and is not legally responsible for the payments ?

Hell, yeah. And maybe the mortgage company, too.

Try talking to www Mortgage Fraud Examiners (com) -- although they are more focused on errors committed by the mortgage lender itself.

There are some law firms that specialize in such things, but so far I have not found any in Virginia. I would be willing to give it a try, but I have not found anyone yet in Virginia who is the equal of some lawyers on this kind of thing in Florida and California.

There is a law firm featured on the Mortgage Fraud Examiners website who won a lot of money in Maryland. They might be comfortable crossing over the river and working with a local Virginia attorney.
