Legal Question in Workers Comp in Virginia

What kind of settlement can we expect from a badly ruptured disc that required a

My husband injured himself on the job from a fall. He has a badly ruptured disc that requires surgery. The badly ruptured disc will be removed and a cadavier bone put back with a metal plate over the inside of his spine. This requires the doctor to go in through the front of the neck because it is pressed against the spine. Because it has been pressed up against the spine, the doctor said he probable would not regain his strength in his arm. The doctor said he would be out of work two months at least. My questions are, if we choose to settle with workers comp, what kind of settlement could we expect for his type of injury. Also, Can you settle for so much and still have lifttime medical too? And one last question do we pay the medical bills we've already madee out of a settlement or will the medical bills be paid as we go by workers comp. I'm sorry for so many questions. My husband has never had an injury or been on workers comp, so we don't know much about this at all. we just don't want to be the one who ends up losing because of an on the job injury. Thanks for any info that you can give me. My husband is fairly young, 32.

Dear Sir or Mam:

This is a very difficult question to answer because it depends on very many factors such as salary at time of accident, ability to earn wages after surgery, degree of medical care required after surgery, nature of limitations after surgery, the particular insurance company you are dealing with, your ability to obtain Social Security Disability if you cannot work after surgery, etc. It would best to consult an experienced workers comp attorney regarding this. I can be reached at 804-358-4766 or 800-256-8862 or email me at [email protected]. Richmond Magazine has recognized me as the best WC Attorney in Central Virgina. I look forward to discussing this with you.
