Legal Question in DUI Law in Washington

My daughter is 14, and she and some other friends had been drinking. The driver of the vehicle is 22. He was driving 110m.p.h. He lost control of the car, Thank God they all lived, the car is totaled it rolled suit a few times. My daughter has Department of Health Insurance, I don't think they will cover this. Also this was his moms car. Do I have they right to sue, as my daughter was injured. Please respond to me fast, as I am disabable and don't have any money. Please help me. My daughter could of died in this accident.
