Legal Question in Family Law in Washington

We are going to file for third party custody of my nephew. My husband is a level one sex offender and has no restrictions about being with children. He was convicted at the age of 12 and is now 32. Do you think that this will interfer with the custody. We live in washington state

It will likely cause some problem but it should not be insurmountable. I would suggest he have some sort of sexual deviancy evaluation ahead of time so that, presuming the evaluation comes back good, it can be shown to any official person who raises the issue --including the court and/or guardian ad litem if any is appointed.
