Legal Question in Family Law in Washington

Found out son is not enrolled full time in college and the one 3 credit class he is attending is going to be dropped

Vancouver, WA

Have never received the proof that he is enrolled in college and in good academic standing so have been putting money aside until have proof. Have been asking since the summer for proof of enrollment and never received. We were informed today that he lost his financial aid due to he and his mother not filling out form correctly and not supplying information the college asked for so his full load was dropped and he re enrolled in one 3 credit class which is probably going to be dropped due to his not paying for the class. Mother is supposed to pay for post secondary support paid directly to the college as well and has not done so. Do we still have to pay the post secondary support or are we done. We live in OR but the case is a WA state case.

The details of the order of support (ORS) set the terms of post secondary education support and who pays, when and how. Assuming the mother is obligated under the order to pay for post secondary support and has not she would be in contempt unless there is a reason that she can not pay the support. Usually the correct course for the mother when she realized that she would not be able to pay the support would have been to file for a modification or adjustment based on change of circumstances. You would have to follow the contempt process, i.e. get an order to show cause re contempt and set a hearing date.
