husband isn't making final payoff

My divorce was final in March. My husband has until September to give me my final payout for our settlement. I am wondering what to do if my husband doesn't pay me on that date? He owes me $16,000. Also, if he doesn't pay, can I move back into the house since it still has my name on the mortgage? The filed paperwork shows he owes me for the equity we had in the house.

Re: husband isn't making final payoff

If your former spouse does not pay the judgment owed to you by the date it is owed, then you may seek enforcement of the judgment. One method of enforcement is to request the court to issue an order of contempt.

To determine who has the right to occupy the former marital residence, refer to the property division portion of the Decree of Dissolution.
