Legal Question in Personal Injury in Washington

MVA Settlement- for 2 minors- FAIR $ ?

Hello-

My 2 minor children and I were in an MVA 1/09- fault of other party. Our Ford Explorer was totalled. My R shoulder is messed up- brachial plexus lesion/TOS- ongoing care, possible surgery.

The kids ages 2 and 6 faired better. Both were properly belted. When all is done and said med. car will be about $1000 each for them. I will probably bring them to a few more PT appointments.

So physically they will heal from this. In a life sense this has been very disruptive. Missed school, minor anxiety in car with my special needs 6 year old. My 2 year old son has had a lot to adjust to. Prior to the accident he slept with us, I did almost all of the caring for him, and I held him A LOT. Now because of my shoulder these things are not possible. Emotionally that has been a difficult change for him.

So I am a wondering given the brief facts what a fair settlement is on the kids? I told the med. adjustor that I was ready to settle that portion.. he will call me back Monday. But I would like a ballpark range if possible.

Don't settle anything. You'll likely need to retain a lawyer for your portion of the case anyway. You might as well wait and have him/her settle the kids as well. Also, the kids may "seem" fine but may not be. Often injuries from accidents take a while to become noticable even to grown ups. Your kids may have more difficulty expressing any problems they may be having. So, wait to settle but hire a lawyer soon.

It is really hard for an attorney to give an idea of what the value of a case is without thoroughly reviewing the entire file, including all of the medical records and bills.
