Legal Question in Wills and Trusts in Washington

Do I have a case?

My mom was sick with Cancer and was taking some heavy medications. I believe that her Brother and his wife manipulated her into making a living will and put there names as the persons to get her money because they knew that she was getting a inheritance from her father after he passed away in 2004. When I read the will recently it says that all of my moms money goes to my uncle which has recently gone through a divorce and is going to use the money from my mom's inheritance to pay off his ex wife. I dont feel that is right I think he should divide it between my sister and I.

There are many questions to ask from your post. You say you believe your uncle forced your mother to sign a living will - that is usually a document that says what kind of life support, if any, a person wants at the end of her life if ill or injured. Did you mother execute a will? Is your mother alive or deceased? It sounds like she may have passed away and now you are talking about her will that says all of her estate goes to her brother.

If you think he unduly influenced her during her lifetime to execute a will that left everything to him, then yes you have a case to pursue and should contact a probate litigator. If you need further assistance, we handle cases like that regularly.
