Legal Question in Family Law in West Virginia

Oral Property Settlement

As part of our divorce ''settlement'', my ex-wife and I entered into an oral property settlement agreement. She was to maintain possession of the marital home and assume responsibility for paying any and all indebtedness secured by the residence. She was also to re-finance the home and maintain taxes, fees, etc. associated with it.

Eleven years later, she has yet to refinance the home, and has a tax lien against it for unpaid municipal fees. Since my name is still attached to the mortgage loan, it is obviously quite a large scar on my credit rating.

Is there anything I can legally do to ''force her hand''?

Re: Oral Property Settlement

Oral property settlement has no legal force and has no value in the eyes of law. You may try for court order in this regard if oral property settlement arrived in the presence of some eye-witness. Consult the attorney/lawyer
