Legal Question in Credit and Debt Law in Wisconsin

debt collections

What are the legalities of debt collectors giving out personal information to anyone other than the individual that owes the debt? I am single 28 y/o and the collections company got a hold of my parents and asked if this was Mrs. ______ and proceeded to give out the information of the entire account, putting unneeded stress on my mother. They thought it was my wife. Any info on this would be greatly appreciated.

Re: debt collections

Athough there are rules against harrassment by collectors,

the WI courts have held that it is not harrassing for a creditor

to make reasonable inquiries with the debtor and relatives about plans for payment

and the status of the account. Your debt collector

does not have the same confidentiallity duties that your doctor has.

Collecting a debt in court is always a fully

public proceeding with all court records

accessable to the general public, often over

the internet. If you have a big problem with debt

collectors, you may wish to consider a more permenant

solution such as debt counseling or bankruptcy. I'd

be happy to go over you situation with you in more

detail if you send a private e-mail.
