father with primary residence took child who lived with mother for years

My wife was divorced from her previous husband 4 years ago. She signed primary residence of their child but with liberal visitation (she assumed he would allow the child to live with her, which was what he stated.) However, he took the child 1,000 miles away when the papers were final. When I married her, the father let the child live with us over 3 years, (she is a straight A student). He recently took the child again out of state and refuses to return. He has documented mental illness and we are worried. What is the best course of action?

You should retain a Family Law attorney in your area as soon as possible. You should file a Petition for Custody. No child deserves bouncing around like this and if it is correct that he has a mental illness that could cause him to harm the child then you need to file as soon as possible.
