Financial ''scam''

My soon-to-be ex is constantly taking money out of our checking account and over-drawing it leaving me to clean up her mess. What are my rights since everything is 50/50 in WI? Can I cancel my checking account and get one myself? Or at least put a freeze on it so she can't keep ''scamming'' me?

I would withdraw everything out, close that account and put it in a new account solely in you name. The problem, however, is that it's marital property, so you cannot spend all of it unless you are awarded all of it in your divorce judgment. But at least it will then be safe that way from her wasting that marital asset until you do get a final judgment in place.
