Legal Question in Insurance Law in Wisconsin

totalled car with no collision insurance

In an accident my car was badly damaged and as per the auto body shop it is totalled. Unfortunately I have not taken collission insurance. As per the police it was my fault. So can I put a third party claim on the other persons insurance whose car hit my car.

He is claiming from insurance company as I have taken property damage.

In the accident my spouse got injured.

My insurance company syas that they will look at medical claim. But this is already covered by my health insurance company. Can i claim for indirct losses due to this injury.

Is there any way to put claim on my insurance.

Thanks

Re: totalled car with no collision insurance

You have a claim for your car & a rental, your spouse's medical bills, any lost time she suffers, and her pain and disability. Assuming the other driver is insured, the only claim I currently see on your policy is for your spouse's medical bills up to your medical payments coverage limit. I suggest using that for copays & deductibles only. Please call if you wish to pursue this further.
