Legal Question in Personal Injury in Wisconsin

My neighbor does not properly supervise her children. Her children climb my apple tree all the time. Am I liable if the child falls out of the apple tree.

I think it would be hard for there to be a successful claim under those facts. You must be determined to have been negligent in order for there to be a judgment taken against you in such circumstances. Unless you are somehow found to have been inviting the children to climb your tree, I doubt that you would be found negligent. If a claim were made against you, your homeowners insurance would pay for a lawyer and would pay any judgment, up to the limits of your liability coverage.
