Legal Question in Workers Comp in Wisconsin

FMLA and how it applies to a Worker out on a Work Comp Leave?

Thank you for your time. I was injured in the state of Florida, after 5 months of trying to deal with a work comp insurance company, I hired an attourney. My question pertains to FMLA and is has 2 parts.

1 If injured on the job, does this time off fall under FMLA ''leave of absence'' guidelines?

2 If the companies' (employers) workers compensation insurance company is the primary source of delay for treatment of injury, does the standard 12 week leave of absence apply?

My current situation, having to handle work comp issues in FL and employment issues in WI, has me doing tons of research. In all of my reading of the FMLA information I have yet to come across work related injuries being considered Leave of absence.

If you have a Workers Compensation attorney, they should be the one advising you, without your having to do additional research on the subject.
